Effective Date: January 15, 2026
Last Updated: January 15, 2026
These Terms of Service ("Terms") govern your access to and use of the ScamsTester website located at scamstester.com (the "Service"), operated by ScamsTester ("we," "us," "our," or the "Company"). By accessing, browsing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
1. Acceptance of Terms
By accessing or using the Service in any manner, including but not limited to visiting the website, searching for website trust scores, using our API, subscribing to our newsletter, or contributing content, you agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
We reserve the right to update or modify these Terms at any time at our sole discretion. Material changes will be communicated by posting the revised Terms on this page with an updated "Effective Date" and, where appropriate, by sending notification to registered users. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
2. Description of Service
ScamsTester provides a free, independent website trust verification and analysis service. Our Service includes, but is not limited to:
- Trust Score Reports: Algorithmically generated trust assessments for websites based on multiple data sources and verification factors.
- Website Directory: A searchable database of analyzed websites with their associated trust scores and reports.
- Blog and Educational Content: Articles, guides, and resources about online safety, scam awareness, and website verification.
- Newsletter: Periodic email communications containing scam alerts, safety tips, and service updates.
- API Access: Programmatic access to our trust score data for qualified developers and organizations, subject to separate API Terms.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. Trust Scores Disclaimer
This section is critically important. Please read it carefully.
3.1 Nature of Trust Scores
Trust scores and reports provided by ScamsTester are generated through automated algorithmic analysis based on publicly available data, technical indicators, and proprietary scoring methodologies. Trust scores are:
- Advisory in nature: They are intended to provide general guidance and should be treated as one of many factors in your decision-making process.
- Not guarantees: A high trust score does not guarantee that a website is safe, legitimate, or trustworthy. A low trust score does not necessarily mean a website is fraudulent or dangerous.
- Point-in-time assessments: Trust scores reflect conditions at the time of analysis and may not reflect subsequent changes to a website's content, ownership, security posture, or business practices.
- Subject to limitations: Our algorithms, while sophisticated, cannot detect all forms of fraud, deception, or security risks. New threats and techniques emerge constantly.
3.2 No Endorsement or Certification
The inclusion of any website in our directory or the assignment of any trust score does not constitute an endorsement, certification, warranty, or recommendation by ScamsTester. We do not certify websites, businesses, or individuals. We are not affiliated with, sponsored by, or endorsed by any of the websites we analyze unless explicitly stated otherwise.
3.3 Your Responsibility
You acknowledge and agree that:
- You are solely responsible for your own due diligence when interacting with any website, regardless of its trust score.
- Trust scores should not be the sole basis for any financial, legal, medical, or other significant decisions.
- You should independently verify information before making purchases, sharing personal data, or engaging with any online service.
- ScamsTester bears no responsibility for any losses, damages, or harm resulting from your reliance on trust scores or any information provided through our Service.
4. Intellectual Property Rights
4.1 Our Intellectual Property

Links to third-party websites do not constitute an endorsement or recommendation by ScamsTester.
Your interactions with third-party websites, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and the third party. You agree that ScamsTester shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third-party links on the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NETVERIFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF TRUST SCORES, REPORTS, OR ANY OTHER CONTENT PROVIDED THROUGH THE SERVICE.
- WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.
- WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM NETVERIFY OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NETVERIFY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
- DAMAGES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE.
- DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SERVICE.
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
- DAMAGES RESULTING FROM YOUR RELIANCE ON ANY TRUST SCORE, REPORT, OR INFORMATION PROVIDED THROUGH THE SERVICE.
IN NO EVENT SHALL NETVERIFY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO NETVERIFY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
THE LIMITATIONS OF THIS SECTION SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF NETVERIFY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
10. Indemnification
You agree to defend, indemnify, and hold harmless ScamsTester and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorneys' fees and court costs) arising from:
- Your use of and access to the Service.
- Your violation of any provision of these Terms.
- Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
- Any content you submit, post, or transmit through the Service.
- Any claim that your content caused damage to a third party.
- Your use of trust scores or data obtained from the Service to make decisions that result in harm to yourself or others.
This defense and indemnification obligation shall survive the termination of these Terms and your use of the Service. ScamsTester reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate fully with ScamsTester in asserting any available defenses.
11. Dispute Resolution
11.1 Informal Resolution
Before filing any formal legal action, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service by contacting us at legal@scamstester.com. We will attempt to resolve the dispute informally within sixty (60) days of receiving your notice.
11.2 Binding Arbitration
If the dispute is not resolved informally, you and ScamsTester agree that any remaining dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in San Francisco, California, unless otherwise agreed by the parties. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
11.3 Class Action Waiver
YOU AND NETVERIFY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Unless both you and ScamsTester agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
11.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California, for the resolution of any disputes arising out of or relating to these Terms or the Service.
If you are accessing the Service from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws. Nothing in these Terms shall be deemed to limit any rights you may have under consumer protection laws in your jurisdiction that cannot be waived or limited by contract.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination:
- Your right to use the Service will immediately cease.
- Any licenses granted to you under these Terms will be automatically revoked.
- All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
- We may, at our sole discretion, delete any data associated with your account, subject to our data retention obligations under applicable law.
You may terminate your use of the Service at any time by ceasing to access or use the Service and, if applicable, by deleting your account. If you have an active API subscription, termination procedures for that subscription are governed by the API Terms.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, Disclaimer, and any additional terms applicable to specific features of the Service (such as API Terms), constitute the entire agreement between you and ScamsTester regarding the use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
14.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.
14.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign our rights and obligations under these Terms without restriction. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
14.5 Force Majeure
ScamsTester shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.
14.6 Notices
Any notices required or permitted under these Terms shall be in writing and shall be deemed effective upon delivery. Notices to ScamsTester should be sent to legal@scamstester.com or to our postal address listed in Section 15.
